Pursuant to the District of Columbia Condominium Act of 1976, Section 313 as well as the Declaration and Bylaws recorded in the land records of the District of Columbia, as Instruments Number 2000090634 on September 28, 2000 and in accordance with Public Law 90-566 and 42 D.C. Code Section 1903.13 as amended, with notice filed on September 21, 2026 as Instrument Number 2026083657, and at the request of the Attorney for the Unit Owners Association, we shall sell at public auction on September 28, 2026 at 11:30 am at the offices of HARVEY WEST AUCTIONEERS, INC. 5335 Wisconsin Avenue NW Suite 440, Washington, DC 20015 202-463-4567 the following condominium unit situated in the District of Columbia and designated on the Records of the Assessor of the District of Columbia for assessment and taxation purposes as Lot 2070 in Square 2662. The condominium unit is sold together with all of the appurtenances incident to said Unit, as contained in the Declaration of Condominium, and simultaneously sold subject to all the provisions, restrictions, easements and conditions as contained in said Declaration of Condominium and the Bylaws relating thereto. It is also sold, pursuant to the terms of the Condominium Declaration, an allocation of an undivided interest (stated as a percentage) in the common elements of the Condominium (hereinafter called the “Percentage Interest”).
TERMS OF SALE:
A deposit of $30,000.00 will be required at the time of sale by certified check. Settlement shall occur within 30 days. The balance of the purchase price, together with interest at the rate of 10% per annum from date of sale to date of receipt of the balance of the purchase price, must be paid by wire transfer and all other terms to be complied with within 30 days, otherwise the deposit shall be forfeited and the Condominium Unit may be re-advertised and resold at the discretion of the Unit Owner's Association and at the risk and cost of the defaulting successful bidder. The Unit Owner's Association shall convey a deed pursuant to 42 D.C. Code Section 1903.13, as amended, and make no further representations or warranties as to title. There will be no adjustments for real estate taxes, water and sewer charges or fees, special assessments, condominium assessments or fees, District of Columbia fines or liens, etc. The Successful bidder assumes all risks of loss following the sale. The successful bidder pays all conveyance fees, recording fees, recordation taxes, transfer taxes, outstanding real estate taxes, outstanding condominium fees, outstanding special assessments, and all outstanding District of Columbia fines or liens, water bills, water and sewer liens. The successful bidder purchases the Condominium Unit subject to all leases.
In addition to the purchase price, the successful bidder purchases the Condominium Unit subject to (and pays in full) all deeds of trust and all liens of record including but limited to District of Columbia tax liens and federal tax liens.
The Condominium Unit is sold in "AS IS, WHERE IS CONDITION and SUBJECT TO ALL FAULTS”, as of the day and time of sale including any tenant or tenancy. Neither the Unit Owners’ Association nor their respective attorneys, agents, members, officers, successors, and assigns, make any representations or warranties with respect to the Condominium , the Zoning Classification, and the existence of a Certificate of Occupancy or Business License, and cannot guarantee clear title or marketable title or the successful bidder’s ability to obtain Title Insurance. For this reason, the Successful bidder may not be able to obtain financing and therefore must be able to pay the purchase balance in any case within 30 days. In the event of failure on the part of the Association to convey a deed pursuant to 42 D.C. Code Section 1903.13, as amended, the successful bidder's sole remedy shall be return of deposit. Upon refund of the deposit, the sale shall be void and of no effect If the Attorney for the Unit Owner’s Association determines, in his sole and absolute discretion, that the final bid is not commensurate with the value of the Condominium Unit, he may reject the bid and withdraw the Condominium Unit from sale.
The Unit Owners’ Association, their attorneys, members or officers shall not be liable or otherwise for any matters relating to this sale, title and/or the Condominium Unit. The defaulting successful bidder shall not be entitled to any surplus proceeds or profits resulting from any resale of Condominium Unit. The Unit Owner’s Association will not deliver possession of the Condominium Unit to the successful bidder, who shall be solely responsible for obtaining physical possession of the Unit.
