Under a power of sale contained in a certain Deed of Trust, Assignment of Leases and Rents, Fixture Filing and Security Agreement ("Deed of Trust") from Preserve at Fox Gap LLC, as grantor, to Jennifer Lader, as trustee, dated September 26, 2025 and recorded on September 30, 2025 in Liber 7770 at Page 12 among the Land Records of Washington County, Maryland, which Deed of Trust secures $7,727,500.00 of indebtedness of that certain Secured Note dated September 26, 2025 in the principal amount of $7,727,500.00, default having occurred under the terms thereof, and pursuant to a Deed of Appointment of Substitute Trustee dated August 5, 2026 and recorded on August 6, 2026 in Book 7986 at Page 199 among the Land Records of Washington County, Maryland appointing Jason A. Pardo (“Substitute Trustee”) as substitute trustee under the Deed of Trust, Substitute Trustee will sell at public auction at the front entrance of the Circuit Court for Washington County, Maryland located at 24 Summit Avenue, Hagerstown, MD 21740, on

September 24, 2026 AT 11:00 AM

ALL THAT FEE-SIMPLE LOT OF GROUND AND ANY IMPROVEMENTS THEREON situated in Washington County, Maryland, commonly known as 6633 Old National Pike, Boonsboro, MD 21713 (PROPERTY ACCOUNT ID NO. 06-015379), and more fully described in the aforesaid Deed of Trust, as well as ALL PERSONAL PROPERTY encumbered by the Deed of Trust (collectively, "Property").

The Property will be sold in an "AS IS" condition and subject to recorded covenants, conditions, restrictions, agreements, and senior liens, if any, and with no warranty of any kind (except as required by the Deed of Trust).

TERMS OF SALE: The Property will be offered as an entirety only. The bid which yields the highest price for the Property will be accepted by the Substitute Trustee (unless the sale is postponed or cancelled) and all bids will be provisional until acceptance. Notwithstanding the foregoing, the Substitute Trustee absolutely reserves the right to postpone the sale and/or cancel the sale at any time until the auctioneer announces that the Property is "sold" and the deposit in the required amount and form is received by the Substitute Trustee. A deposit in the amount of $100,000.00 will be required at the time of sale. Such deposit must be by cashier's check or certified check or in such other form as the Substitute Trustee may determine in his sole discretion. In the event the deposit is less than 10% of the winning bid amount, then the deposit must be increased to 10% of the winning bid amount and delivered to the Substitute Trustee within one (1) business day after the consummation of the sale in the same form of funds as the initial deposit or in such other form as the Substitute Trustee may determine in their sole discretion. Failure to timely tender the deposit or additional deposit shall constitute a material default by the purchaser and result in forfeiture of the deposit. Interest to be paid on the unpaid purchase money at the rate in effect under the debt instrument secured by the Deed of Trust from the date of sale to the date of settlement. Secured Party, if a bidder, shall not be required to post a deposit or to pay interest.

Purchaser shall settle within ten (10) days of final ratification of the sale by the Circuit Court for Prince George’s County. TIME SHALL BE OF THE ESSENCE WITH RESPECT TO SETTLEMENT BY PURCHASER. Cost of all documentary stamps (recordation taxes), transfer taxes and settlement expenses shall be borne by purchaser. Taxes, ground rent, water, and sewer, if applicable, are to be adjusted for the current year to the date of sale and assumed thereafter by purchaser.

In the event purchaser does not settle as required for any reason, purchaser shall be in default. Upon such default, Trustee may file a motion to resell the Property at the risk and expense of defaulting purchaser. Purchaser hereby consents to entry of such resale Order without further notice. Defaulting purchaser shall not be entitled to any surplus proceeds or profits resulting from any resale of the Property, and the deposit shall be forfeited to the Trustee and all of the expenses of this sale (including attorneys' fees and full commission on the gross sale price) shall be charged against and paid out of the forfeited deposit. Purchaser shall pay all attorneys' fees and costs, and all other damages of any kind or nature, incurred by Trustee and the secured party, and their respective agents, employees, successors and assigns, in connection with any such default.

If Trustee is unable to convey title, purchaser's sole remedy at law and in equity shall be limited to a refund of the deposit and the sale shall be considered null and void and of no effect.

Purchaser shall be responsible for obtaining physical possession of the Property. Purchaser assumes the risk of loss or damage to the Property from the date of sale forward.

Trustee reserves the right, in his sole discretion, to reject any and all bids, to withdraw the Property from sale at any time before or at the auction, to extend the time to receive bids, to waive or modify the deposit requirement, to waive or modify the requirement that interest be paid on the unpaid purchase money, and/or to extend the period of time for settlement.

Additional terms may be announced at the sale. Purchaser will be required to execute and deliver to Trustee a contract of the sale at the conclusion of the bidding.

Neither the Trustee nor the secured party, nor their respective agents, employees, successors, and assigns, make any representations or warranties, express or implied, with respect to the Property, or any tenancies or parties in possession, including, without limitation, the value, description, use, structural integrity, physical condition, construction, extent of construction, workmanship, materials, habitability, subdivision, zoning, environmental condition, compliance with building codes or other laws, ordinances, or regulations, fitness for a particular purpose or merchantability of all or any part of the Property.
