By virtue of the power and authority contained in Security Agreement from Virginia G Horstkamp, Debtor to PNC Bank, National Association, dated December 19, 2006, default having occurred under the terms thereof, and at the request of the party secured thereby, by its undersigned attorney will sale at public auction at Charles County Circuit Court, 200 Charles Street (breezeway between circuit and district courts)
All the membership shares described in said Security Agreement being shares of Potomac Heights Mutual Home Owners Association, Inc. allocated to 30 Greenwood Place, Indian Head, MD 20640, together with all rights, duties and obligations under the terms of a certain Occupancy Agreement between Virginia G Horstkamp , and Potomac Heights Mutual Home Owners Association, Inc. Subject to the terms, provisions and conditions contained in the Articles of Incorporation, By-Laws, Occupancy Agreement and House Rules of Potomac Heights Mutual Home Owners Association, Inc.
The membership shares will be sold subject to their proportionate share of certain underlying purchase money mortgages, the exact amount due thereon will be announced at time of sale and subject to all conditions, liens restrictions and agreements of record affecting same, and subject to any assessments.
TERMS OF SALE: A cash deposit, certified check or cashier's check in the amount of $20,000.00 will be required of the purchaser at the time and place of sale, except that the Secured Party will not be required to give a deposit. Balance to be paid in cash 30 days following sale. Interest to be charged at the rate of 6.75% per annum on the unpaid purchase price from date of sale to date of settlement. All costs incident to the transfer of membership shares shall be borne by the purchaser. All adjustments of cooperative fees and assessments will be made as to date of sale, and to be assumed by thereafter by the purchaser. In the event that the purchaser fails to go to settlement as required, the property shall be re-sold at purchaserâ s risk and expense and the deposit is forfeited.
